Regulamin
**§ 1 Preliminary Provisions**
The online store Weronika Truszczyńska is operated by Weronika Truszczyńska, registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for economic affairs, NIP 744-182-67-09, REGON 388416056.
**§ 2 Definitions**
Consumer – a natural person concluding a contract with the Seller in the Store, whose subject is not directly related to their business or professional activity.
Seller – a natural person conducting business under the name Weronika Truszczyńska, registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for economic affairs, NIP 744-182-67-09, REGON 388416056.
Client – any entity making purchases through the Store.
Entrepreneur – a natural person, legal person, and organizational unit that is not a legal person, which has legal capacity granted by a separate law, conducting business on their own behalf and using the Store.
Store – the online store operated by the Seller at the internet address rajemirrors.pl.
Distance contract – a contract concluded with the Client within an organized system for concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication until the contract is concluded.
Regulations – these regulations of the Store.
Order – the Client's declaration of intent made using the Order Form and aimed directly at concluding the Sales Agreement for the Product or Products with the Seller.
Account – the client's account in the Store, where the data provided by the Client and information about Orders placed by them in the Store are collected.
Registration form – a form available in the Store, enabling the creation of an Account.
Order form – an interactive form available in the Store that allows placing an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
Cart – a software component of the Store, where the Products selected by the Client for purchase are visible, and it is also possible to establish and modify Order data, particularly the quantity of products.
Product – a movable item/service available in the Store that is the subject of the Sales Agreement between the Client and the Seller.
Sales Agreement – a sales agreement for the Product concluded or to be concluded between the Client and the Seller via the online Store. The Sales Agreement also refers to service agreements and contracts for work, depending on the characteristics of the Product.

The Client can communicate with the Seller using the addresses and phone numbers provided in this paragraph.
**§ 4 Technical Requirements**
To use the Store, including browsing the Store's assortment and placing orders for Products, the following is necessary:
- an end device with internet access and a web browser,
- an active email account,
- cookies enabled,
- installed FlashPlayer.
**§ 5 General Information**
To the fullest extent permitted by law, the Seller is not liable for disruptions, including interruptions in the operation of the Store caused by force majeure, unlawful actions of third parties, or incompatibility of the online Store with the Client's technical infrastructure.
Browsing the Store's assortment does not require creating an Account. Placing orders for Products available in the Store can be done either by creating an Account in accordance with the provisions of § 6 of the Regulations or by providing the necessary personal and address data enabling the execution of the Order without creating an Account.
Prices displayed in the Store are given in Polish złoty and are gross prices (including VAT).
The final amount payable by the Client consists of the price for the Product and the delivery cost (including transport, delivery, and postal service fees), which the Client is informed about on the Store's pages during the Order process, including at the moment of expressing the intent to enter into the Sales Agreement.
In the case of an Agreement covering a subscription or the provision of services for an indefinite period, the final price is the total price covering all payments for the billing period.
When the nature of the subject of the Agreement does not allow for a reasonable assessment of the final price in advance, information about how the price will be calculated, as well as transportation, delivery, postal service fees, and other costs, will be provided in the Store in the Product description.
**§ 6 Creating an Account in the Store**
To create an Account in the Store, it is necessary to fill out the Registration Form. The following data must be provided: first name, last name, email address.
Creating an Account in the Store is free of charge.
Logging into the Account is done by providing the username and password set in the Registration Form.
The Client may at any time, without giving any reason and without incurring any costs, delete their Account by sending a relevant request to the Seller, particularly via email or in writing to the addresses provided in § 3.
**§ 7 Rules for Placing an Order**
To place an Order, you must:
- log into the Store (optional);
- select the Product that is the subject of the Order and then click the "Add to cart" button (or equivalent);
- log in or use the option to place an Order without registration;
- if the option to place an Order without registration is selected – fill out the Order Form by entering the recipient's details and the address to which the Product is to be delivered, select the type of shipment (method of delivering the Product), enter billing information if different from the recipient's details,
- click the "Order and pay" button/click the "Order and pay" button and confirm the order by clicking the link sent in the email,
- choose one of the available payment methods and, depending on the payment method, pay for the order within the specified time, subject to § 8, point 3.
**§ 8 Available Delivery and Payment Methods**
The Client may choose from the following methods of delivery or collection of the ordered Product:
- Postal shipment, cash on delivery postal shipment,
- Courier shipment, cash on delivery courier shipment,
- Personal pickup available at: Unii Europejskiej 4, 14-260 Lubawa, Poland.
The Client may choose from the following payment methods:
- Payment on delivery
- Electronic payments
- Payment by credit card.
Detailed information about delivery methods and acceptable payment methods can be found on the Store's pages.
**§ 9 Execution of the Sales Agreement**
The conclusion of the Sales Agreement between the Customer and the Seller occurs after the Customer has placed an Order using the Order Form in the Online Store, in accordance with § 7 of the Regulations.
After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for execution. The confirmation of receipt of the Order and its acceptance for execution occurs by sending the Customer an appropriate email to the email address provided during the Order placement, which includes at least the Seller's statements regarding the receipt of the Order and its acceptance for execution, as well as confirmation of the conclusion of the Sales Agreement. Upon receiving the above email, the Sales Agreement is concluded between the Customer and the Seller.
If the Customer has chosen a delivery method other than personal pickup, the Product will be sent by the Seller within the timeframe indicated in its description (subject to paragraph 5 of this section), in the manner chosen by the Customer during the Order placement.
A. In the case of ordering Products with different delivery dates, the delivery date is the longest indicated date.
B. In the case of ordering Products with different delivery dates, the Customer has the option to request delivery of the Products in parts or delivery of all Products once the entire order is complete.
The start of the delivery period for the Product to the Customer is calculated as follows:
In the case of the Customer choosing payment by bank transfer, electronic payment, or credit card – from the day the Seller's bank account is credited.
In the case of the Customer choosing cash on delivery – from the day the Sales Agreement is concluded.
In the case of choosing personal pickup of the Product, the Product will be ready for pickup by the Customer within the timeframe indicated in the Product description. The Customer will be additionally informed of the Product's readiness for pickup by the Seller by sending an appropriate email to the email address provided during the Order placement.
In the case of ordering Products with different readiness dates for pickup, the Customer has the option to pick up the Products in parts (according to their readiness for pickup) or to pick up all Products once the entire order is complete.
The start of the readiness period for the Product for pickup by the Customer is calculated as follows:
In the case of the Customer choosing payment by bank transfer, electronic payment, or credit card – from the day the Seller's bank account is credited.
In the case of the Customer choosing cash upon personal pickup – from the day the Sales Agreement is concluded.
Delivery of the Product is made only within Poland.
Delivery of the Product to the Customer is charged unless the Sales Agreement states otherwise. The costs of delivering the Product (including transportation fees, delivery, and postal services) are indicated to the Customer on the Online Store pages in the "Delivery Costs" section and during the Order placement, including at the moment the Customer expresses their willingness to conclude the Sales Agreement.
Personal pickup of the Product by the Customer is free of charge.
**§ 10 Right of Withdrawal from the Agreement**
A Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
The period specified in paragraph 1 begins from the delivery of the Product to the Consumer or to a person designated by them other than the carrier.
In the case of an Agreement covering multiple Products delivered separately, in batches, or in parts, the period indicated in paragraph 1 runs from the delivery of the last item, batch, or part.
In the case of an Agreement that involves the regular delivery of Products for a specified period (subscription), the period indicated in paragraph 1 runs from the possession of the first item.
A Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. To meet the withdrawal period, it is sufficient for the Consumer to send a statement before the expiration of this period.
The statement may be sent by traditional mail, fax, or electronically by sending the statement to the Seller's email address or by submitting the statement on the Seller's website – the Seller's contact details are specified in § 3. The statement can also be submitted using a form, the template of which constitutes Annex No. 1 to these Regulations and is an attachment to the Act of May 30, 2014, on consumer rights, although this is not mandatory.
If the statement is sent by the Consumer electronically, the Seller will immediately send the Consumer a confirmation of receipt of the withdrawal statement to the email address provided by the Consumer.
Effects of Withdrawal from the Agreement:
In the case of withdrawal from a distance Agreement, the Agreement is considered not concluded.
In the case of withdrawal from the Agreement, the Seller shall refund the Consumer without delay, no later than 14 days from the day of receiving the Consumer's statement of withdrawal from the Agreement, all payments made by them, including the costs of delivering the item, except for additional costs resulting from the chosen delivery method other than the cheapest ordinary delivery method offered by the Seller.
The Seller will make the refund using the same payment methods used by the Consumer in the original transaction, unless the Consumer explicitly agreed to a different solution that will not incur any costs for them.
The Seller may withhold the refund until receiving the Product back or until providing proof of its return, depending on which event occurs first.
The Consumer should return the Product to the Seller's address provided in these Regulations without delay, no later than 14 days from the day they informed the Seller of their withdrawal from the Agreement. The deadline is met if the Consumer returns the Product before the 14-day period expires.
The Consumer bears the direct costs of returning the Product, including the costs of returning the Product, if due to its nature, the Product could not be returned by ordinary mail.
The Consumer is only liable for the diminished value of the Product resulting from its use in a manner other than that necessary to ascertain the nature, characteristics, and functioning of the Product.
If, due to the nature of the Product, it cannot be returned by ordinary mail, information about this, as well as about the costs of returning the Product, will be included in the Product description in the Store.
The right to withdraw from a distance Agreement does not apply to the Consumer concerning the Agreement:
- in which the subject of the service is a non-prefabricated item produced according to the Consumer's specifications or serving to satisfy their individualized needs,
- in which the subject of the service is an item delivered in a sealed package that cannot be returned for health or hygiene protection reasons if the package was opened after delivery,
- in which the subject of the service is an item subject to rapid deterioration or having a short shelf life,
- for the provision of services if the Seller has fully performed the service with the explicit consent of the Consumer, who has been informed before the performance of the service that upon the Seller's fulfillment of the service, they will lose the right to withdraw from the Agreement,
- in which the price or remuneration depends on fluctuations in the financial market that the Seller does not control and which may occur before the withdrawal period expires,
- in which the subject of the service is items that, after delivery, due to their nature, become inseparably connected with other items,
- in which the subject of the service is alcoholic beverages whose price was agreed upon at the conclusion of the sales agreement, and which can be delivered only after a period of 30 days and whose value depends on fluctuations in the market that the Seller does not control,
- in which the subject of the service is audio or video recordings or computer programs delivered in a sealed package if the package was opened after delivery,
- for the delivery of newspapers, periodicals, or magazines, except for a subscription agreement,
- for the delivery of digital content not stored on a tangible medium if the performance has begun with the explicit consent of the Consumer before the withdrawal period expires and after the Seller has informed them of the loss of the right to withdraw from the Agreement.
**§ 11 Complaints and Warranty**
The Sales Agreement covers new products.
The Seller is obliged to deliver the Customer an item free from defects.
In the case of a defect in the product purchased from the Seller, the Customer has the right to make a complaint based on the provisions regarding warranty in the Civil Code.
The complaint should be submitted in writing or electronically to the addresses provided in these Regulations.
The Seller will respond to the complaint request immediately, no later than 14 days, and if they do not do so within this period, it is considered that the Customer's request has been recognized as justified.
Goods returned under the complaint procedure should be sent to the address: Unii Europejskiej 4, 14-260 Lubawa, Poland.
In the case where a warranty has been granted on the Product, information about it, as well as its content, will be included in the description of the Product in the Store.
** § 12 Extrajudicial Methods of Handling Complaints and Pursuing Claims**
Detailed information regarding the possibilities for consumers to use extrajudicial methods of handling complaints and pursuing claims, as well as the rules for accessing these procedures, is available at the offices and websites of county (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, and Voivodeship Inspectorates of Trade Inspection, as well as on the following websites of the Office of Competition and Consumer Protection: [http://www.uokik.gov.pl/spory_konsumenckie.php](http://www.uokik.gov.pl/spory_konsumenckie.php); [http://www.uokik.gov.pl/sprawy_indywidualne.php](http://www.uokik.gov.pl/sprawy_indywidualne.php); and [http://www.uokik.gov.pl/wazne_adresy.php](http://www.uokik.gov.pl/wazne_adresy.php).
Consumers have the following examples of possibilities to utilize extrajudicial methods of handling complaints and pursuing claims:
1. A consumer is entitled to apply to the permanent consumer arbitration court mentioned in Article 37 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws of 2014, item 148, as amended) with a request for resolution of a dispute arising from an agreement concluded with the seller.
2. A consumer is entitled to apply to the Voivodeship Inspector of Trade Inspection, in accordance with Article 36 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings for an amicable resolution of the dispute between the consumer and the seller.
3. A consumer can obtain free assistance regarding the resolution of a dispute between them and the seller, also using the free assistance of the county (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., the Federation of Consumers, the Polish Consumers' Association).
** § 13 Personal Data in the Online Store**
The administrator of personal data of customers collected via the online store is the seller.
Personal data of customers collected by the administrator via the online store is collected for the purpose of fulfilling the Sales Agreement, and if the customer consents, also for marketing purposes.
Recipients of personal data of customers of the online store may include:
- In the case of a customer who uses postal or courier delivery in the online store, the administrator provides the collected personal data of the customer to the selected carrier or intermediary executing shipments on behalf of the administrator.
- In the case of a customer who uses electronic payment methods or credit card payments in the online store, the administrator provides the collected personal data of the customer to the selected entity servicing the above payments in the online store.
The customer has the right to access their data and to correct it.
Providing personal data is voluntary; however, not providing the personal data indicated in the Regulations necessary for concluding the Sales Agreement results in the inability to conclude the agreement.
** § 14 Final Provisions**
1. Agreements concluded through the online store are made in Polish.
2. The seller reserves the right to make changes to the Regulations for important reasons, i.e., changes in legal regulations, changes in payment and delivery methods, to the extent that these changes affect the implementation of the provisions of these Regulations. The seller will inform the customer of any changes at least 7 days in advance.
3. In matters not regulated by these Regulations, generally applicable provisions of Polish law apply, in particular: the Civil Code; the Act on Providing Services by Electronic Means; the Act on Consumer Rights; the Act on Personal Data Protection.
4. The customer has the right to use extrajudicial methods of handling complaints and pursuing claims. For this purpose, they can file a complaint through the EU online ODR platform available at: [http://ec.europa.eu/consumers/odr/](http://ec.europa.eu/consumers/odr/).
